Halleluiah!! Score one for team End Affirmative Gender Care Mutilation of Minors. Late last month, 22-year-old plaintiff Fox Varian won a two million dollar settlement against psychologist Dr. Kenneth Einhorn and plastic surgeon Dr. Simon H. Chin. Ms. Varian had a bilateral mastectomy at age 16 as part of her gender transition from female to male. She now identifies as female and has permanently lost her ability to ever breast feed a child. The trial only considered the care that Ms. Varian had received. The complainant alleged negligence, failure to obtain informed consent, and reckless disregard for mental and emotional health. Ms. Varian’s mother stated that although she was not in favor of the surgery, she consented because she was told by the professionals involved with her daughter’s care that her daughter was at increased risk of committing suicide. Ms. Varian’s mother believed she had no choice but to consent to the surgery. There are currently 28 gender transition lawsuits in the pipeline. Of note, after the jury verdict, the American Society of Plastic Surgeons (ASPS) issued new guidance for gender care and acknowledged insufficient evidence is currently available demonstrating that irreversible surgical gender reassignment interventions have long-term benefits for minors and therefore recommends a delay of gender related breast, genital, and facial surgery until a patient is at least 19 years old. The ASPS also stated that they had “substantial uncertainty” about long-term benefits of puberty blockers and cross sex hormones for the treatment of juvenile gender dysphoria. The American Medical Association (AMA) has also come out with a statement since the malpractice verdict and has appeared to back down on support of surgical treatment for most minors. The organization has left a window cracked open for some surgical treatment and the door wide open for medical/endocrine treatment with cross sex hormones and puberty blockers. The American Academy of Pediatrics (AAP) is continuing its support of surgical and medical/endocrine gender transition interventions in the pediatric population. I believe the medical profession will soon have an awakening by virtue of the legal profession that “it’s not nice to fool Mother Nature.”
