The U.S. Supreme Court began hearing oral arguments this week for First Choice Women’s Resource Centers v. Platkin. First Choice Women’s Resource Centers are pro-life, faith based pregnancy resource centers with five locations in New Jersey. Matthew Platkin (D) has been the New Jersey Attorney General since his appointment by New Jersey Governor Phil Murphy (D) in February 2022. AG Platkin is exceptionally pro-abortion and is on record as claiming pro-life groups are “extremists attempting to stop those from seeking the reproductive healthcare that they need.” Soon after assuming office and without citing any evidence, AG Platkin issued a statewide “consumer alert” declaring that pro-life pregnancy centers “provide false or misleading information.” AG Platkin solicited Planned Parenthood’s help in writing the consumer alert. In November of 2023, AG Platkin, without a single complaint from a First Choice client or donor, issued a subpoena demanding First Choice turn over 10 years worth of documents including its statements on abortion pill reversal, information it provided to clients and donors, documents identifying personnel, copies of every First Choice solicitation and advertisement, and information related to outside organizations with whom First Choice partners. In addition, Platkin’s subpoena demanded names, phone numbers, and addresses of First Choice’s donors. Platkin absurdly claimed that he needed donor names because donors may have been “confused” that First Choice does not provide abortions. Democrat New Jersey Attorney General Platkin is engaged in lawfare against an organization that does not religiously or politically align with his views. AG Platkin desires to keep the legal situation in state court in New Jersey. Alliance Defending Freedom (ADF), the legal entity representing First Choice, has opted to move the case to the federal court system because of civil rights violations committed by the State of New Jersey regarding First Choice. The current case before the U.S. Supreme Court is a jurisdictional issue regarding state court versus federal court. ADF had a favorable ruling this week in the U.S. Second Circuit Court of Appeals (3-0) regarding the free speech right of pregnancy resource centers (PRC) to discuss abortion pill reversal with clients. New York Attorney General Letitia James has been engaged in legal maneuvering to ban PRCs from discussing or referring clients for abortion pill reversal. The Supreme Court will most likely be issuing a ruling on First Choice Women’s Resource Centers v. Platikin in June of 2026.
