Budget News Tuesday.
1. State of Ohio. Although Governor DeWine was on a line item veto frenzy -67- I was happy to see that my new flat state income tax rate will be 2.75%. Also, a tax credit of $750 remains in place for pregnancy resource center donations. I am not happy to see how much Ohio taxpayers are on the hook for a new professional sports complex in Cleveland – $600,000,000. The Cleveland Browns moved into their current stadium in 1999. Itâs a shame that modern sports complexes do not have the same life expectancy as the old Roman Coliseum. Hopefully, the Ohio Legislature will override vetoes on education spending accounts for students who attend non-chartered religious schools and a provision requiring books on gender identity and sexual orientation to be placed out of childrenâs view.

2. Federal budget. The Senate has passed the OBBB with J.D. Vance providing the tie breaking vote. All Democrats opposed the OBBB in addition to Republican Senators Thom Tillis (NC), Rand Paul (KY), and Susan Collins (ME). The budget bill is now back in the U.S. House of Representatives and is facing strong head winds. Lots of games went on the last few days in the Senate. One of the biggest disappointments to me was the 44 Senate members who think it is OK for illegal aliens to be enrolled in the Medicaid program. WTF??? Inquiring minds are curious as to the payoff Senator Lisa Murkowski (AK) received for her affirmative vote to push the OBBB over the line.

1. Today was a great day for the rule of law. In Trump v. Casa, the Court handed down a 6-3 decision that federal district courts lack the constitutional and statutory authority to issue âuniversalâ injunctions. The United States has 94 federal court districts and of 40 universal injunctions issued regarding Trump executive actions, 35 came out of 5 federal court districts. In writing for the majority, Justice Barrett was quite forward in her opinion of Justice Jacksonâs dissent. Justice Barrett wrote, âWe will not dwell on Justice Jacksonâs argument, which is at odds with more than two centuriesâ worth of precedent, not to mention the Constitution itself. We observe only this: Justice Jackson decries an imperial executive while embracing an imperial judiciary.â Ouch. Since the Supreme Court stressed that injunctions apply only to actual litigants in a particular case, Casa has already filed an emergency petition and is going the class action route. A decision regarding the birth right citizenship aspect of this case will probably not come down until October. In a 6-3 decision of Mahmoud v. Taylor, the court affirmed parentsâ right to opt their children out of LGBTQ+ themed instruction. Amen and Hallelujah.

2. Ohio Senate Bill 1, The Advance Higher Education Act, went into effect today. The law bans Diversity, Equity, and Inclusion (DEI) courses, training, and required statements; spending on DEI initiatives or programs with the same intent; and political and ideological litmus tests in all hiring, promotions, and admission decisions at Ohioâs state colleges and universities. Signature collection for a referendum petition to repeal Senate Bill 1 has fallen short to the required number of signatures.
