Pro-Life News:

1. First Choice Women’s Resource Centers, Inc. v. Davenport, Attorney General of New Jersey. In 2022, former New Jersey Attorney General Matthew Platkin set up a Reproductive Rights Strike Force, with the help of Planned Parenthood, to target pro-life pregnancy centers. A consumer alert was issued in 12/2022 encouraging the public to file complaints against pro-life pregnancy centers for providing “false or misleading information about abortion.” In addition, Platkin issued a subpoena to First Choice Women’s Resource Centers requesting the organization to turn over 10 years’ worth of documents including the names, addresses, and employer information of donors. Platkin also asked for detailed First Choice employee information. First Choice is a small non-profit with five centers. The paperwork production burden would have crippled the organization in its ability to provide services. Additionally, the doxing of donors threatened First Choice’s income stream. As the subpoena dealt with Civil Rights abuses on the part of the State of New Jersey, First Choice’s legal team, Alliance Defending Freedom (ADF), opted to seek legal remedy in the federal courts. Unfortunately, the 3rd District Court and 3rd Circuit Court of Appeals ruled against ADF on jurisdiction and “ripeness” grounds thus bouncing the fight to NJ’s state court jurisdiction. ADF took the case to the Supreme Court on Civil Rights claims asking the Supreme Court to remand the case to the 3rd District Federal Court. In a 9-0 decision, the Supreme Court remanded the case to the federal court. Justice Thomas was a real gem during the hearing. His question for N.J., “Can you tell us about the complaints you have received against First Choice?” The answer, “There have been none.” Of note, 42 amicus briefs were filed in the case with a 39:3 split in favor of First Choice. Even the ACLU filed in support of a donor privacy shield. Please pray for First Choice and ADF. The New Jersey Attorney General staff is now scampering like cockroaches when a light is turned on to push this case rapidly through the state court system. New Jersey wants some legal wins to present in Federal Court.

2. Mifepristone. Up until the Covid fiasco, abortion pills could only be prescribed with an office visit. During Covid, this “best practice” rule was lifted. In 2023, the “no office visit required” for mifepristone became permanent. The State of Louisiana is currently in a federal court battle with the pro-choice forces regarding mifepristone being obtained via telehealth visits and across state lines. The 5th Circuit Court of Appeals issued a stay on 5/1/2026 which requires an office visit for mifepristone while the court case plays out. On 5/4/2026, the Supreme Court lifted the stay until 5:00 p.m. 5/11/2026 while the Supreme Court considers the merits of the 5th Circuit Court of Appeals stay. As a retired, board certified physician, I find it unbelievable that any board certified physician would think it is OK to prescribe mifepristone via telehealth. It is imperative that every pregnancy undergoing a medical abortion is accurately dated and an ultrasound can only be done during an office visit. Mifepristone is ONLY indicated for pregnancies under 10 weeks gestation. Also, mifepristone carries some contraindications and warnings – bleeding disorders, adrenal insufficiency, severe asthma – that are best managed with office visits and follow-up. It is easier to lie online than it is in person. Every medical abortion should have a follow up ultrasound to make sure the abortion is complete and this appointment can be scheduled during the appointment where the medical abortion pills are prescribed. I am vehemently opposed to abortion, but if we are going to allow abortion, it should be done in an environment better than “treat ‘em and street ‘em.”
