3. Judicial Roundup. Tomorrow, Tuesday, 1/13/2026, the Supreme Court will begin to hear the case of West Virginia v. B.P.J. BPJ is a biological male who gender identifies as female. In 2021, W.V. enacted the Save Women’s Sports Act (SWSA). BPJ had been competing in girls’ cross-country and track. BPJ’s mother, acting on BPJ’s behalf, sued the W.V. Board of Education and other state and county education entities. The Southern District of W.V. Court upheld the SWSA. On appeal in the 4th Circuit, the SWSA was struck down as unconstitutional. The State of West Virginia appealed the court finding to the Supreme Court. The Supreme Court granted the petition on 7/3/2025. Oral arguments begin tomorrow. We have a similar law in Ohio regarding women’s sports, so this is an important Supreme Court case. Tomorrow’s Supreme Court case also includes Little v. Hecox which involves the State of Idaho and 9th Circuit Court of Appeals.
